{1} Defendants University of New Mexico Board of Regents and University of New Mexico Health Sciences Center (UNMHSC) appeal after a bench trial resulted in a verdict in favor of Plaintiff Arnold Lucero. Defendants argue that the district court erred in denying its motion for summary judgment on Plaintiff’s breach of contract claim because Plaintiff did not exhaust the grievance procedures contained in UNMHSC’s human resources policies and procedures manual (the employee handbook).
