W. H. Scarborough sued Miss Emma Cloud in a justice’s court, on a promissory note. The case was appealed to the superior court of Sumter county, and came in for a trial in its regular order June 4, 1907. The defendant filed -a plea setting up that T. B. Powell was the true maker of the note sued upon, and that she signed the same as surety, and that both of the notes sued upon were secured by mortgages on personal property, and that said mortgages were not recorded by the plaintiff.
