A final decree was entered in this suit in equity on October-8, 1930. On the same day the plaintiff filed an appeal from that decree. On October 21, 1930, the plaintiff filed with the clerk a written order for the preparation of the necessary papers for the appeal. On the following day the clerk mailed an estimate of the cost to the plaintiff who remitted on October 25, 1930, and the papers were sent to the printer. On October 30 the defendant filed in the Superior Court a motion for the dismissal of the appeal on the ground that there had been failure to comply with St. 1929, c. 265, § 1.…
