The first question presented upon this record is the sufficiency of the various counts of the indictment. We will consider these counts in the reverse order of their numbering. The fifth, sixth and seventh counts are alike in substance, and each of them presents only that plaintiffs in error did “ unlawfully, malicious!y,wrongfully and wickedly conspire and agree together with the fraudulent and malicious intent, then and there wrongfully and wickedly to injure the business and property of the Lumberman’s Building and Loan…
