■ This suit was instituted by appellee against appellant on a policy of insurance for $2,-500 issued by appellant on the life of Tom O. Morris, father of appellee, together with 12 per cent, penalty and attorney’s fees. The cause was tried to a jury, submitted on special issues, and resulted in judgment being entered for appellee for the amount of the policy, together with 12 per cent, penalty and $500 attorney’s fees.

Appellant complains of that portion of the judgment which permitted appellee to recover interest and attorney’s fees; his contention being that it is 'not such an insurance…
