This case is before us on certified questions from the Court of Civil Appeals at Waco. The certificate is as follows:

“In 1905, seven individual citizens formed an incorporate voluntary association for the purpose of mutually insuring the respective lives of its members on such terms and conditions as might be established by the constitution and by-laws of said corporation, and obtained from the State of Texas a charter for the association, which was incorporated under the name of The Home Mutual Life Insurance…
