Appeal by the plaintiff, Isaiah Keyser, from a judgment of the Supreme Court in favor of the defendant, entered in the office of •the clerk of the county of New York on the 16th day of March, 1900, upon the decision of the court rendered after a trial before the court without a jury at the New York Trial Term.

This action was tried at Trial.Term without a jury. At the close of the plaintiff’s case the defendant moved to dismiss the complaint, which motion was granted.
The defendant is a co-operative or assessment insurance company. On the 15th of February, 1881, the plaintiff became a member of the corporation, and the defendant issued to him a certificate of membership, a copy of which is annexed to the complaint.
