Appeal from District Court, Jefferson County; L. B. Hightower, Jr., Judge. Action by H. Masterson against the City of Beaumont. Judgment for plaintiff, and defendant appeals.

This is a suit by H. Masterson against the city of Beaumont to collect the balance due on a paving contract, with interest. The case was tried with the assistance of a jury. The court submitted the case to the jury on two special issues, and upon the return of a verdict favorable to the plaintiff on both issues rendered a judgment for plaintiff for $14,095.40, with interest from the date of the judgment at the rate of 6 per cent, per annum, and awarding a peremptory writ of mandamus to the mayor and councilmen, ordering the levying and collection of the necessary tax to pay the judgment.
