This is an action for personal injuries founded on the Federal Employers’ Liability Act. Defendants are the receivers of the St. Louis & San Francisco Railroad Company, an interstate carrier, and at the time of his injury, February 21, 1914, plaintiff was the foreman of a gang of section men employed in repairing a main track in defendants’ switch yards in Kansas City. The men were raising low joints in the track and had been thus employed during the day.
