I. Nature of the Case

The State charged Kyle A. Richardson with three counts of delivery of a controlled substance in violation of I.C. § 37-2732(a)(1)(A). After a preliminary hearing in which a confidential informant testified for the State, the State filed a motion requesting that the district court allow the State to admit into evidence at trial a transcript of the confidential informant’s preliminary hearing testimony.
