HAWKINS, Judge.
Appellant is under conviction for the murder of John Greenwood with punishment assessed at confinement in the penitentiary for life.
The parties- to the homicide are negroes. The evidence discloses that although appellant was a married man about three years prior to the homicide he had deserted his wife and maintained adulterous relations with one Lillian Henderson. This continued up to some three or four months prior to the killing when Lillian declined longer to maintain such relations. About a' month before the killing she had commenced receiving attention from deceased.…
