On February 15, 2009, Kenneth Gallups sued Dillard’s, Inc., seeking workers’ compensation benefits (“the workers’ compensation claim”) and alleging that Dillard’s had discharged him from his employment in violation of Ala.Code 1975, § 25-5-11.1, solely because he had made a claim for workers’ compensation benefits (“the retaliatory-discharge claim”); that action was assigned case number CV-09-900091.
