In a proceeding to confirm an arbitration award, in which respondent cross-moved to vacate the award, the petitioner appeals from an order of the Supreme Court, Suffolk County, dated September 13,1976, which, inter alia, denied the petitioner’s application to confirm the award and granted the cross motion to vacate the award. Order reversed, on the law, with $50 costs and disbursements, award confirmed, and cross motion denied. No findings of fact were presented for review.
