The accused was convicted1 on thirteen specifications of larceny by check, all in violation of Article 121, Uniform Code of Military Justice, 10 USC § 921. He was sentenced to a bad-conduct discharge, total forfeitures, confinement at hard labor for six months, and reduction to the grade of basic airman. The convening authority affirmed both the findings and sentence; however, a board of review in the office of The Judge Advocate General of the Air Force granted a rehearing on both for an alleged error by the law officer in refusing to admit…
