This suit was brought by N. F. Miller and E. C. Moore, partners, against Don Rathbun, for damages growing out of the alleged faulty construction of a cold storage and refrigeration plant. It was alleged that the plant was not built in accordance with representations made at the time of the execution of the contract inducing its execution, and that it was not built in accordance with the contract between the parties; that it would not function properly, and jvould not retain low temperature.
