Defendant Lumbermens Mutual Casualty Co. (Lumbermens) appeals from a judgment of the United States District Court for the Southern District of New York, Kevin T. Duffy, J., granting the motion for summary judgment of plaintiff-appellee Boston Old Colony Insurance Co. (Boston). Boston brought this diversity case against Lumbermens after Lumbermens denied any liability in connection with the settlement of a lawsuit arising out of a car accident.
