(after stating the facts as above). The contention of appellant is that the evidence presented before the com*704missioner was not sufficient to justify his apprehension and commitment for trial, if the crime had been committed here. His argument in support of this contention proceeds upon the theory that the evidence should be sufficient to sustain a conviction, which is a wholly mistaken conception of the practice in these cases.
