Appeal from the Jackson Circuit Court. — Hon. .John W. Henry, Judge. (1) In order to recover, respondent must prove all the material allegations of the petition. An instrument signed* by Bingham alone was read in evidence, which purports to be an assignment of a half interest in his contract to Todd, and which recites and ratifies the power of attorney executed by Bingham to J. One J. H. Bingham was a contractor with the City of Kansas to construct a first-class sidewalk along a portion of Main street, and defendant Ridge, the owner of certain abutting lots. After the completion of the work tax bills were issued by the proper officer and delivered to Bingham (or rather to Guinotte, his assignee), and- this suit is brought by Guinotte, under an alleged assignment from.
