Petitioner Roman Luckey brought a putative class action against real parties in interest Cotton On USA, Inc., and Cotton On Clothing Pty Ltd. (collectively Cotton On) for violations of the federal Fair and Accurate Credit Transactions Act of 2003 (FACTA; Pub.L. No. 108-159 (Dec. 4, 2003) 117 Stat. 1952). Prior to class certification, Luckey and Cotton On mediated their dispute and reached a class settlement agreement.
