Defendant was indicted and tried on three charges: (1) the murder of James Holloman in 98 CRS 6784; (2) the attempted armed robbery of James Holloman in 98 CRS 6786; and (3) the armed robbery of Timothy Mitchell in 98 CRS 6785. The evidence presented at trial tended to establish the following facts. On 24 April 1998, at approximately 10:00 p.m., Timothy Mitchell went to the Starling Way shopping center in a jeep driven by his mother, Faye Mitchell, with his two nephews, ages 5 and 9, in the back seat.
