This writ of error brings up for review a judgment of the Hudson County Circuit Court in favor of the defendant below, the Jersey City, Hoboken and Paterson Street Eailway Company, in an action of tort brought by Albert Uirk, the plaintiff in error.

The plaintiff was a passenger upon a trolley car of the defendant company on the 19th day of February, 1905. The car was a closed car with a high winter door on each side, extending from the platform to the top of the ear. The plaintiff stood on the rear platform. The ear was running in an…
