CORNELIUS, Justice.

This suit was filed by appellee William Cope against M. C. Winters, Inc., and M. C. Winters, individually, to recover damages for breach of contracts alleged to have been made between Cope and M. C. Winters, Inc., which Cope alleged granted him the exclusive right to haul mulch sod for Winters on a highway construction job in Bowie County, Texas. Trial was to a jury. Based upon the jury’s answers to special issues the trial court entered judgment in favor of Cope against only M. C. Winters, Inc., for damages and attorney’s fees in the total sum of $27,820.25. M.
