James D. Buttgen brought this action against Robert K. Eisenbeck alleging that on February 28, 1966 he went to work for Eisenbeck under an oral employment contract for an indefinite period of time at a stipulated salary and, in addition, “a guarantee of one-third (i/$rd) to one-half Q4) of five per cent (5%) of the gross receipts of defendant’s business.” He alleged that the difference in the guaranteed percentage was based upon the fact of hiring several additional employees but that only one additional employee was hired, and therefore he was entitled to one-half of…
