ERVIN, Circuit Judge.
The Virginia law firm of Boothe, Prichard & Dudley sued Jefferson-Pilot Fire & Casualty Company to recover damages for Jefferson-Pilot’s failure to defend Boothe, Prichard under its professional liability policy in a civil antitrust suit (the Kahn suit).1 The district court granted Boothe, Prichard summary judgment on the issue of liability, denied it attorney’s fees incurred in bringing the instant action, and deferred the question of damages for later trial.
