This case is a part of In re Air Cargo Shipping Services Antitrust Litigation, 06-md-1775 (E.D.N.Y.), an MDL based on an alleged price-fixing conspiracy among airlines providing freight shipping services. Defendant Qantas Airways Limited (“Qantas”) moves to dismiss Plaintiff Schenker AG’s (“Schenker”) Complaint (“Compl.”) under Fed. R. of Civ. P. 12(b)(6), arguing that the case was not filed within the Clayton Act’s four-year statute of limitations, even after tolling is taken into account.
