This action is for the partition of certain land which formerly was a part of Bernheimer avenue in St. Paul. Plaintiff claimed to own an undivided one-third interest in the land, and each of defendants: Hewitt an undivided third. The trial court decided that neither' plaintiff nor the Hewitts had any interest in the land, but that the* same was owned by defendant Jefferson, subject to a contract with! the defendant railway company. Plaintiff moved for a new trial',, and appealed from the order denying such motion. The ultimate question here is whether plaintiff had any interest in the land.…
