11 This is a criminal matter. Defendant Erneal Davis appeals his conviction and sentence on one count of second degree murder. This is the defendant’s third appeal. The defendant has also filed several writ applications in this matter. In a counseled assignment of error, the defendant contends that the trial court erred in refusing to grant him a new trial on the ground that trial counsel was ineffective in that she failed to consult with him prior to the commencement of trial.
