In this action the plaintiff seeks a permanent injunction compelling the defendants, members of the New Haven board of police commissioners and the city of New Haven, to appoint him to the position of supernumerary policeman. The action first came to court on June 11, 1974, when the plaintiff obtained a temporary injunction permitting his attendance at the department of police service training program. The defendants filed an answer on July 2, 1974, denying the operative portions of the plaintiff's complaint. Thereafter an evidentiary hearing was held on August 6, 1974.
