Per Curiam:.

This is an action to recover survivor’s benefits pursuant to § 3108 of the no-fault act, MCL 500.3108; MSA 24.13108. Following a bench trial, the trial court entered judgment for plaintiff in the amount of $24,985. Plaintiff was also awarded 12% per annum penalty interest and attorney fees. Defendant appeals as of right.
