Appeal from a judgment of the superior court for Lincoln county, Heal, J., entered October 14, 1904, upon findings in favor of the plaintiff, after a trial on the merits before the court without a jury, adjudging the defendant guilty of contempt of court.

This is a contempt proceeding. A restraining order was issued out of the superior court of Lincoln county, Washington, on the 5th day of August, 1904, forbidding the appellant from obstructing a certain highway, in Lincoln county. On the 27th day of September, 1904, upon the application and affidavit of the prosecuting attorney of said county, setting up facts showing a violation of said restraining order, an order was made and entered commanding the arrest of the appellant.
