MEMORANDUM OPINION AND ORDER
SIDNEY B. BROOKS, Bankruptcy Judge.
THIS MATTER comes before the Court on a Motion to Dismiss or Abstain filed by the Colorado State Bank Commissioner (“Commissioner”), which Motion was joined by the Office of the United States Trustee (“U.S. Trustee”). The Industrial Bank Savings Guaranty Corporation (“IBSGC”), a non-profit corporation created by the Colorado Legislature to provide protection for customers’ deposits in member Colorado industrial banks, filed an amicus curiae brief in support of the Motion to Dismiss.
