MEYERS, Bankruptcy Judge:

I

This is an appeal from the trial court’s refusal to set aside an ex parte order encumbering a residence. Credit Alliance Corporation (“Credit Alliance”), an unsecured creditor of the estate, appeals on four grounds. First, Credit Alliance contends that the ex parte order should be set aside because, contrary to statute and the Constitution of the United States, no notice or hearing was given before the order issued.
