Appeal from circuit court, New York county. Action by the mayor, etc., of the city of New York, against the National Broadway Bank of the city of New York. From a judgment for plaintiff defendant appeals.

The action was brought to recover interest upon deposits of money belonging to the city and county of New York made with the defendant. These deposits commenced about the first of the year 1861, and interest was paid by the defendant upon the deposits to the chamberlain of the city of New York up to and including the time of the enactment of chapter 623 of the Laws of 1866.1 The payments of interest preceding that date do not appear to have been either precise or regular, but they were paid to the chamberlain from time to time, and probably amounted to the rate of 4 per cent, upon the…
