T. MICHAEL PUTNAM, UNITED STATES MAGISTRATE JUDGE

The plaintiff, Edwin Omar Perez, himself a former employee of the Social Security Administration, appeals from the decision of the Commissioner of the Social Security Administration (“Commissioner”) denying his application for a period of *1203disability and Disability Insurance Benefits (“DIB”). Mr. Perez timely pursued and exhausted his administrative remedies and the decision of the Commissioner is ripe for review pursuant to 42 U.S.C. §§ 405(g), 1383(c)(3).
