This suit was brought by the Citizens’ National Bank of Hillsboro, Tex., in the county court of Hill county, against W. O. Whitlock as maker and J. D. Abney as indorser of a promissory note described in' plaintiff’s petition. The plaintiff alleged, and the facts developed, that the note was signed by Whitlock and was payable to the order of “J. D. Abney, executor,” and was indorsed as follows: “J. D. Abney, executor.” The *735defendant “Whitlock filed no answer, and judgment by default was taken against him.
