This petition for mandamus was filed against the police committee of the City of Atlanta,'to require reinstatement of the petitioner to the office of city policeman. There being no issues of fact, the case was tried by the judge on the pleadings, and a mandamus absolute was refused. On December 3, 1931, tire petitioner was convicted of murder, with a recommendation to mercy, and sentenced to life imprisonment; and after a first new trial, he was again convicted, with the same verdict and sentence.
