Plaintiff-appellant Ealing Corporation (Ealing) appeals the dismissal of its combination contract/tort claim against defendant-appellee Harrods, Ltd. (Harrods) for “lack of jurisdiction over the person.” Fed.R.Civ.P. 12(b)(2). Ealing alleged that Harrods breached express and implied agreements governing a marketing venture between the two companies whereby a “pilot scheme” was set up for the catalog sale of Harrods’ merchandise in the United States.
