This is a suit to recover for personal injuries. The plaintiff, in company with a young woman, was going west upon Seventy-fifth street, across the' tracks of the defendant in error at'about the midnight hour. These tracks are used also by trains of the Michigan Central Bailroad Company. The plaintiff states that as he and his companion approached the crossing they found the gates open, and that when they had crossed several intervening tracks, they saw a Michigan Central train coming slowly from the north.
