Appellant’s first assignment of error is that the trial judge refused to grant the application for a change of venue. The issues had once been tried before another judge of the Superior Court with a jury, and a verdict rendered in favor of the administrator, which ivas set aside and a new trial granted. February 18, 1896, the case was announced for trial the day following, before the Hon. John Barton Payne, who took up on the 18th the calendar of another judge.
