This is an appeal from the judgment and sentence of the Municipal Court of Napoleon in which the defendant-appellant, Alfredo Arrizóla, was convicted of operating a motor vehicle while under the influence of alcohol and driving with an expired driver’s license.
The facts of this case are not in dispute. In the early morning hours of August 26, 1990, Arrizóla was arrested for driving under the influence of alcohol in violation of R.C. 4511.19(A)(1) and (A)(3), as well as driving with an expired license in violation of R.C. 4507.02.
