The offense is murder; the punishment, death.

It was charged in the indictment in substance that appellant, with malice aforethought, killed John Stowe by shooting him with a pistol.

Shortly prior to the homicide appellant and Joe Aycock had been drinking together. In the course of the evening they went to the Kentucky Club in the city of San Antonio. Aycock was carrying a pistol. As they approached the club, Aycock observed a city policeman standing near the door. At this juncture appellant engaged Aycock in a scuffle.
