Mrs. Muriel M. Seyfert as widow and executrix of her husband, Dr. Carl Seyfert, deceased, recovered a judgment against Newark Insurance Company, and Newark has appealed in error.

By her declaration plaintiff alleged Dr. Seyfert had been employed by Vanderbilt University as a professor of astronomy and to run, manage and maintain the Arthur J. Dyer Observatory, its equipment and properties operated by and under the auspices and as a part of Vanderbilt University in connection with its research and educational activities.
