STOKES, Justice.
This is a suit in trespass to try title filed by appellee, L, O. McClusky, as purchaser of the land involved at a trustee’s sale made untier a foreclosure of a deed of' trust executed by appellant,. Thos. J. Hart, to M, H. Gossett as trustee for the Federal Land Bank of Houston. The deed of trust was executed on the 20th of August, 1926, and M. H. Gossett, the. original trustee, died May 13, 1934. The note secured by the deed of trust was payable on the amortiza tion pían under which the accrued interest and a portion of the principal was payable semi-annually, and appellant…
