Plaintiff, Maglificio Berga, an Italian corporation and the unpaid seller, brought this action seeking damages or recovery of goods against Amit International Trade, Ltd. (hereafter referred to as “Amit”), a Pennsylvania corporation and the buyer, and Fidelity Bank. Presently before the court is Fidelity’s motion for summary judgment. Berga’s action against Amit is based on Berga’s June 6, 1978 sale of garment and clothing products worth $138,-515.79 to Amit.
