The defendant, Goo Wan Hoy, ivas indicted, tried and convicted of perjury alleged to have been committed while he was testifying in an equity proceeding pending before the Hon. C. W. Ashford, first judge of the circuit court of the first judicial circuit. The indictment contained two counts. The first count charged the defendant with hav*723ing sworn falsely that he saw W. G.
