Joseph Boyle was seriously injured by an automobile tire that exploded at a repair shop. The shop was insured by Zurich American Insurance Company under a business auto policy with a $50,000 limit on bodily injury coverage. After Boyle and his wife sued the repair shop for negligence, Zurich failed to defend, the repair shop failed to appear, and as a result a default judgment now worth $3.7 million was entered against the repair shop.
