Affirming.

Coleseott Harding is appealing from a judgment sustaining a demurrer to the petition as amended' in an action brought in the name of the Commonwealth of Kentucky for his use and benefit against Anslem J. Bartholomew, a constable of J efferson county, and the Fidelity & Casualty Company of New York, surety on his official bond, and dismissing the petition upon failure to further plead.
