This proceeding raises questions about the application of the current version of the statutory provisions governing voluntary departure. It involves an alien who, after being granted the privilege of voluntary departure, neither timeously departed nor requested an extension or stay of the voluntary departure deadline. The Board of Immigration Appeals (BIA) thereafter denied the alien’s motion to reopen his removal proceedings on the ground that his non-compliance with the voluntary departure terms rendered him statutorily ineligible for the relief that he hoped to obtain…
