The parties agree that on January 16, 1922, they entered into a contract in writing in the following terms, omitting signatures and acknowledgment.
“This Article oe Agreement, made and executed this 16th day of January, 1922, by and between Henry P. Norton, party of the first part, and Wilbur L. Rayburn and Iva B. Rayburn, his wife, parties of the second part.
“Witnesseth, That the party of the first part for and in consideration of the covenants and agreements herein contained to be well and truly performed by the parties of the second part does hereby agree to convey to said second…
