Niemann, J.:

The defendant has been indicted by the grand jury of Nassau county under two indictments, one charging arson in the second degree, the other, containing three counts: the first count alleging an attempt to commit robbery in the first degree; the second,, an attempt to commit extortion; and the third, assault in the first degree. Upon the indictment for arson the defendant has been tried -and acquitted.
